Notice of Final Disparity Study Report - Southern California Regional Disparity Study

The Southern California Regional Disparity Study Consortium, composed of SANDAG, Metropolitan Transit System (MTS), Los Angeles County Metropolitan Transportation Authority (LACMTA), Orange County Transportation Authority (OCTA), and the Southern California Regional Rail Authority (Metrolink), recently finished conducting a Southern California Regional Disparity Study to assist the consortium members in making decisions concerning their compliance with the federal Disadvantaged Business Enterprise (DBE) Program for Federal Transit Administration-funded projects.

Public forums were held in October 2009 to gather input on the Draft Disparity Study. The public forum provided opportunities to the public to share personal experiences and other information related to the implementation of the DBE Program, including whether there was discrimination affecting contracting in the transportation industry. Both oral comments from the public forum and written comments from the public sent into SANDAG were included in the Final Disparity Study Report.

Each participating agency received a final disparity study evaluating its own region- and agency specific contracts. Some key considerations addressed in SANDAG’s FTA Disparity Study include the following:

1. Setting the base figure for DBE participation in FTA-funded contracts.
2. Determining feasibility of achievement of the annual goal through race-neutral and, if appropriate, race-conscious means.
3. Identifying specific measures to be used in implementing the FTA DBE program.

The SANDAG FTA Disparity Study has now been completed, and the SANDAG Board of Directors accepted the FTA Disparity Study for use in preparing a DBE goal for FTA-funded projects for the upcoming Federal Fiscal Year (FFY) 2011, which begins in October 2010.

The SANDAG Board of Directors is expected to approve a goal-setting methodology and goal for FFY 2011 for submission to FTA at its May 2010 business meeting.
